Liability Waiver for Ark of Compassion (“AoC”) Online Programs
1. I am voluntarily participating in a program or programs provided by AOC. The programs are offered online by video, television, apps or other digital media or platform. I will be receiving and following instruction and information concerning mindfulness techniques, which may include physical and mental activities.
2. I understand that I must be in adequate physical and mental health to participate in the program(s). I represent and warrant that I have no physical or mental health condition that would prevent my safe participation in these programs. I acknowledge and agree that AoC is not a medical professional and does not provide any medical diagnoses or treatments. If I have any medical condition, I will seek the help of a medical professional. I further understand that it is my responsibility to consult with a physician (especially if I am pregnant, or have a history of heart block) and obtain the permission of a physician prior to engaging in any mindfulness training. I understand that AoC reserves the right to refuse my participation in any program(s) on medical, fitness or any other grounds.
3. I am aware that my participation in the program(s) could result in unexpected physical and/or mental conditions due to the physical and emotional challenges in the program(s) offered. I understand my physical and mental limitations and I am sufficiently self-aware to stop or modify my participation before I become injured.
4. I am willingly and voluntarily assuming any risks, injuries, and damages, known and unknown, which I might incur as a result of participating in these classes, including those which may result from the negligence of AoC and agree that AoC will not have any liability for such injuries or damages, to the maximum extent allowed by applicable laws.
5. To the maximum extent permitted by applicable law, I hereby (a) waive and release any claims, known or unknown, I may have against AoC, including its instructors, officers, directors, employees and agents (“Related Party”), arising from or in connection with the services provided by Ark of Compassion.
6. I agree to indemnify and hold harmless AoC and each Related Party from any loss, cost, or liability incurred in defending any and all claims made by me or anyone making a claim on my behalf.
7. I expressly waive all rights afforded by any statute which limits the effect of a release with respect to unknown claims.
